Welcome to Laser Bear Industries. These Terms of Service ("Terms") govern your use of our website (www.laserbear.net) and any purchases or interactions you make with us.
1. Acceptance of Terms
By accessing or using this site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the site.
2. How These Terms Apply
These Terms have two parts:
- Sections 3–16 are the general terms and apply to all customers.
- Section 17 (Additional Terms for EU/EEA Consumers) applies only to consumers resident in the European Union or European Economic Area.
If you are an EU/EEA consumer and anything in Sections 3–16 conflicts with Section 17 or with the mandatory consumer-protection laws of your country of residence, Section 17 and those laws take precedence. Nothing in these Terms removes or reduces any right you have under applicable consumer law that cannot be waived by agreement.
3. Orders, Payment & Pricing
Your submission of an order is an offer to purchase. We may accept or decline it (see Section 10). All prices are listed in U.S. Dollars unless otherwise noted. We may correct errors in pricing, descriptions, or availability at any time before a contract is formed.
4. Shipping, Title & Risk of Loss
Shipping times are estimates and not guaranteed.
For customers outside the EU/EEA, ownership and risk of loss transfer to you upon shipment of the product.
EU/EEA consumers: risk of loss passes to you only when you take physical possession of the goods — see Section 17.
5. Returns & Refunds
Please refer to our Refund Policy for details. Returns must meet the conditions outlined therein. Certain items may be non-refundable or subject to a restocking fee.
EU/EEA consumers: restocking fees do not apply to a valid exercise of your right of withdrawal, which is governed solely by Section 17.
6. Intellectual Property
All content on this site, including text, images, logos, and designs, are the property of Laser Bear Industries or its licensors. You may not copy, reproduce, distribute, or use any content without written permission.
7. Prohibited Uses
You may not use the site to:
- Violate any laws or regulations
- Infringe upon intellectual property rights
- Distribute malware or spam
- Interfere with the site's functionality or access
8. Disclaimer & Limitation of Liability
Except as required by law, this site and all products are provided "as is" without warranties of any kind, and we disclaim all warranties, express or implied. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the preceding 12 months.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes, without limitation, liability for death or personal injury caused by negligence, liability under applicable product-liability law, and — for EU/EEA consumers — any non-excludable statutory consumer rights described in Section 17.
9. Indemnification
You agree to indemnify and hold harmless Laser Bear Industries, its affiliates, and employees from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the site. This indemnity does not apply to the extent a claim arises from our own acts or omissions, and it does not affect the statutory rights of consumers.
10. Order Acceptance and Right to Refuse Service
Your submission of an order is an offer to purchase, which we may accept or decline at our discretion. A contract is formed only when we confirm dispatch of the goods. We reserve the right to decline or cancel any order, refuse service, and close or restrict customer accounts, including (without limitation) where:
- we are unable to verify the information provided;
- the order appears to be placed for resale, or in a quantity or pattern inconsistent with ordinary personal use;
- we reasonably believe an account is being used in bad faith, fraudulently, or in a manner that abuses our policies or systems;
- a customer has engaged in abusive, threatening, or defamatory conduct toward our business or staff; or
- continuing to supply the customer is, in our reasonable judgement, no longer commercially viable.
Where we decline or cancel an order, any payment taken for that order will be refunded in full. Declining future orders does not affect any statutory rights a customer holds in respect of purchases already made.
This section governs whether we choose to enter into new contracts. It does not limit, condition, or penalize any statutory right a customer may have under applicable consumer law.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Nebraska, and disputes will be resolved in the state or federal courts located in Douglas County, Nebraska.
This choice of law and forum does not deprive any consumer of the protection afforded by mandatory provisions of the law of their country of residence, including, for EU/EEA consumers, the right to bring proceedings in their home courts where applicable law so provides.
12. Unsolicited Commercial Communications
We do not accept or consent to unsolicited commercial proposals or marketing outreach, including but not limited to SEO, advertising, or development services. Sending such material does not create any business relationship or obligation on our part. We may block senders and report unsolicited commercial messages as spam under applicable anti-spam laws, and continued outreach after a request to cease may be pursued accordingly.
13. Customer Reviews
We may moderate or remove customer reviews that contain unlawful, false, or off-topic content, including: profanity, harassment, threats, or defamatory statements; personal or private information; content that is fraudulent, fake, or incentivized; or material unrelated to the product or purchase.
We do not remove honest reviews simply because they are negative or critical of our products, service, or shipping.
14. Changes to Terms
We may update these Terms from time to time. Changes take effect upon posting, and the "Last Updated" date will reflect the most recent revision. Changes do not apply retroactively to contracts already formed.
15. Rewards Program
The rewards program is opt-in and must be signed up for in advance of any order to qualify for reward points. Points are awarded based on order value and can be redeemed for discount codes in the rewards pop-out window. We may modify or discontinue this program at any time; reasonable notice will be given where practicable, and any unused points may be lost on discontinuation.

17. Additional Terms for EU/EEA Consumers
This section applies only if you are a consumer resident in the EU/EEA. Where it conflicts with Sections 3–16, this section and the mandatory law of your country of residence prevail.
17.1 Statutory Conformity Guarantee
We are under a legal duty to supply goods that conform to the contract. You are entitled to the statutory legal guarantee of conformity (a minimum of two years from delivery under EU law, and longer where your national law provides). The "as is" disclaimer and the liability cap in Section 8 do not limit these rights or our liability for death, personal injury, or defective products.
17.2 Risk of Loss
Risk of loss or damage to the goods passes to you only when you (or a third party you nominate, other than the carrier) take physical possession of the goods. Items lost or damaged in transit before that point remain our responsibility.
17.3 Right of Withdrawal
You have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party you nominate, other than the carrier) acquire physical possession of the goods. Where your order is delivered in multiple shipments, the period runs from possession of the last item.
To exercise this right, you must inform us of your decision by a clear statement — using the withdrawal button on our website, the EU Withdrawal option in our site menu, or by contacting us at support@laserbear.net. To meet the deadline, it is sufficient that you send your communication before the withdrawal period expires.
Effects of withdrawal. If you withdraw, we will reimburse all payments received from you, including the standard delivery costs (but excluding any extra costs arising from your choice of a delivery type other than the cheapest standard delivery we offer). We will make the reimbursement no later than 14 days from the day we are informed of your decision, using the same means of payment you used, at no fee to you. We may withhold reimbursement until we have received the goods back, or until you supply evidence of having returned them, whichever is earliest.
Return of goods and return costs. You must send back the goods without undue delay and no later than 14 days from the day you communicate your withdrawal. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning. No restocking fee applies to a withdrawal under this section.
Defective goods. This withdrawal right concerns change-of-mind returns. Where goods are faulty, not as described, or otherwise non-conforming, your statutory rights under Section 17.1 apply and we bear the cost of return.
Exceptions. The right of withdrawal does not apply to goods made to your specifications or clearly personalized, nor to other categories excluded by law (e.g. sealed goods unsuitable for return for health/hygiene reasons once unsealed).
17.4 Dispute Resolution
Nothing in these Terms affects your right to bring a claim under the mandatory consumer-protection law of your country of residence. The European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.
18. Entire Agreement
These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Laser Bear Industries regarding your use of the site.
